The good compare sheet done by pixl shows (at least to me) that there is pretty less need for changes. Instead of enhancing the statute I would go for downsizing. 🙂
I agree completely 😀 That sounds like the Dutch way 😀 , which is not always the right approach 😉
I will leave the legal part to others as I am not familiar with German law. But to start a friendly conversation about the purpose of the changes, here are my thoughts. It is just my opinion, nothing more. I don't want to start any fight.
Again thanks to Pixl for making such a great comparison.
I have used the new numbering.
1.2.3 und den Erhalt der Atari-Computer.
According to FlorianD this needs a signature from every member. I think Abbuc already preserves the Atari, so no need for this.
2.3, 2.4, Clarification about paying the fees and change from a monthly fee to a annual fee. Termination of membership starts automatically when a member does not pay.
Looks alright to me. Abbuc takes financial risks, so I think monthly payments are too risky. The automatic termination helps saving money, because a member who does not pay, will not get the next magazine anymore.
2.5 The board reserves the right to terminate a membership
Looks fine to me. It was already in the statutes (9.2 in old numbering)
3 Change from monthly membership to annual membership.
Again, financial risks. I can understand that.
4 Services
Looks alright. Just a update and in the text is explained that these can be changed during a JHV.
4.1 Magazine in German language.
I don't mind. It is a German club. But for me it is unknown what is meant here exactly. Must all software (Polish, English and so on) on the disk be translated to German? Or are we talking about the paper supplement? Is this limited to one language? I can see a future that Abbuc will be more (financially) dependent on foreign members. For me, the magazine must be in German as much as possible, but does this proposal limit the number of languages besides German? I think this should not be in the statutes. This is a topic for a JHV. And that is in aligment with 4 and 6.6. That part explains how to add or change the services.
4.2 Change from physical disk to ATR, physical disk when members ask for it.
Very understandable. The last U.S. company who provided 5.25 disks stopped producing them. There will be a time that Abbuc cannot buy around 2500 disks each year (Sadly).
More Services
Looks alright. Just a update. In 1985 there was no internet 😀
5.1 Board, adding one member
For a large club five board members sounds goods. I don't know exactly what "Beisitzer" means, but I hope this person can take over for other board members when one member is sick, is temporarily busy elsewhere, on holiday and so on.
6.5 Change in procedure to propose changes in the statutes
Fine, as this procedure is used now for these changes in the statutes, I guess this is German law?
6.6 What can be changed during the JHV
Fine. This is a bit of a duplicate of what is written in 4.
